Professional Engineers Ontario - Discipline Committee (DIC) Public Members/Adjudicators Search

Professional Engineers of Ontario (PEO) is seeking individuals with adjudicative experience to serve as public members on the Discipline Committee (DIC). This Committee hears and decides matters of professional misconduct or incompetence. The DIC ensures the fair and impartial adjudication of allegations against members of the Association, including certificate of authorization holders and those holding various engineering licenses.

Position Overview:

  • Area of Law: Administrative.
  • Position type: Committee member.
  • Experience: Minimum 5 years of experience as an adjudicator or in a similar role.

Qualifications:

The selection process for the appointment of members of the Discipline Committee is competitive. The following criteria will be used to assess candidates:

  • Experience, knowledge, or training with respect to administrative law or related areas.
  • Strong aptitude for impartial adjudication.
  • Familiarity with the Statutory Powers Procedures Act (SPPA) is an asset.
  • Knowledge of Professional Engineers Act and Regulation 941 and 260 is an asset.

Duties and Responsibilities:

  • Serve in an adjudicative role in a quasi-judicial setting.
  • Hear and decide matters referred to the Discipline Committee.
  • Lawyer members will draft the first version of decisions and reasons documents for review by the full panel.
  • Adhere to the principles of natural justice or procedural fairness (e.g., the right to be heard and right to an impartial decision maker).
  • Exercise decision making powers under s.28 of the Professional Engineers Act.

  • The Discipline Committee is a tribunal that hears and determines allegations of professional misconduct or incompetence against a member of the Association or a holder of a certificate of authorization, a temporary licence, a provisional licence or a limited licence.
  • All parties involved will have an opportunity to be heard, and decisions of the tribunal will be based on the facts and the law.

Panel Composition:

  • The DIC Chair appoints panels of 3 members to hear each matter.
  • Hearings occur regularly, and their duration varies from one-day to multiple days in a row, or spread out over several months.
  • Persons appointed by the Attorney General are expected to take a lead role in drafting timely decisions and reasons.

Term & Remuneration:

  • Term Duration: Initial 1-year term with the possibility of reappointment for up to 3 additional three-year terms.
  • Members are expected to volunteer for multiple hearings per year and attend bi-annual DIC meetings.
  • Remuneration:
    • $56.86 per hour based on a 7-hour day.
    • $398 per diem rate
