Hearing Officer- Two Appointments

The City of Oshawa is seeking Hearing Officers to adjudicate over matters pertaining to the City’s by-laws on an as-needed basis.  

As the City’s Hearing Officer, you will review decisions made by Screening Officers in relation to municipal by-law penalties issued as part of the City’s Administrative Monetary Penalty System (AMPS) and review appeals related to orders, licence denials and exemption requests in relation to various City by-laws. Your duties as a Hearing Officer will include: 

  • Conducting hearings in accordance with the Statutory Powers Procedure Act, 1990 and exercise the power of decision in the review of appeals, as set out in the various by-laws, for the City of Oshawa; and
  • Making rulings and issuing oral and written decisions that are independent and free of outside influence.

All decisions made by Hearing Officers are deemed final and binding, and hearings may be conducted in person, virtually or in writing.  Members of Council, employees of the City of Oshawa, the child, parent or spouse of a Member of Oshawa Council or employee of the City and persons indebted to the City are not eligible to apply.

Your qualifications as a Hearing Officer include the following:

  • Preferably, you are a member of The Society of Ontario Adjudicators and Regulators (SOAR) and/or The Law Society of Ontario (LSO);
  • You hold a post-secondary degree or diploma in law, mediation or arbitration, or a related discipline, and/or an equivalent combination of education and experience;
  • You have knowledge and experience with respect to adjudicative processes, including conducting trials or hearings for a tribunal or court;
  • You have both knowledge of, and experience in interpreting and applying, appropriate
    legislation, including City of Oshawa by-laws, the Municipal Act, 2001, the Provincial Offences Act, 1990, and the Statutory Powers Procedure Act, 1990;
  • Knowledge of access to information and privacy legislation (Municipal Freedom of Information and Protection of Privacy Act, 1990);
  • You are knowledgeable and experienced in mediation and alternative dispute resolution;
  • You bring highly effective leadership, facilitation, communication, presentation, interpersonal and organizational skills;
  • You have respect for access to justice, diversity, and accommodation;
  • You are able to formulate reasoned decisions and communicate them clearly and effectively, both orally and in writing;
  • You are committed to ongoing professional development, to enhance your expertise and remain current in the field;
  • You are computer literate and have experience using Microsoft Word, Outlook, and Webex/Zoom;
  • You cannot act or continue to act as an Agent for applicants before other City proceedings (e.g. other Hearings, Committee of Adjustment, Property Standards Committee etc.); and
  • You have the flexibility to provide services on a part-time basis (up to 2 days per month), or as required. These part-time positions offer a per diem of $300 per half day and $600 for full day.
