College of Nurses Ontario - Prosecutions Associate (Temporary to July 2025)

JOB PURPOSE 

Oversees and manages proceedings before the Discipline and Fitness to Practise Committees, including collaborating with system partners and ensuring legislative timelines are met.

Supervises the team’s work activities by providing staff oversight, support, coaching and consultation; reviewing quality of work, identifying strategies to facilitate success to ensure team contribution achieve organizational goals.

 

KEY RESPONSIBILITIES 

  • Plans, recruits, trains, and supervises staff to achieve team goals related to the prosecution and/or resolution of allegations of misconduct, incompetence and/or incapacity.
  • Oversees and manages the prosecution of matters before the Discipline and Fitness to Practise Committees and unregistered practitioners by coordinating and monitoring processes; instructing external CNO legal counsel; identifying and resolving procedural, regulatory and statutory issues that arise; negotiating with self-represented members.  
  • Explains regulatory processes to relevant parties and system partners related to the prosecutions function, and shares expertise and regulatory knowledge with internal CNO teams.
  • Drafts, prepares, and reviews legal documents.
  • Oversees recruitment and management of expert witnesses.
  • Works in collaboration with other CNO teams to implement process improvements ensuring consistency and legislative compliance

 

 

REQUIRED QUALIFICATIONS   

  Education and Experience  

  • LL.B. or JD
  • Practicing Lawyer in good standing with Law Society of Ontario, with 3 or more years of relevant experience
  • Experience providing direction and supervision to staff

Job Competencies, Knowledge, Skills  

 

  • Analytical and Critical Thinking – Uses solid knowledge and understanding of relevant legislation and its application, such as the Regulated Health Professions Act, 1991, Nursing Act, 1991, administrative law and other legal principles (e.g., procedural fairness and confidentiality), CNO By-Laws and Practice Standards, to support the prosecution of and/or resolve matters before the Discipline and Fitness to Practise Committees. Uses analytical techniques to evaluate complex information and reach a conclusion in continuously evolving situations.

 

  • Communication – Uses effective communication skills to prepare complex legal documents in a clear and concise manner and convey complex legal and process information in plain language to foster understanding. Adjusts communication delivery when difficulty in understanding arises.

 

  • Consulting and Advising – Consults and discusses complex legal and regulatory issues with external CNO legal counsel, and shares expertise with internal CNO teams. Initiates and participates in development of process improvements and collaborates with internal CNO teams and external CNO legal counsel to ensure legislative compliance.

Hiring Range: $120,562 - $128,116

Full Salary Range: $120,562 - $144,674
