One year after our first webinar addressing pandemic-related issues and the rise of online justice, SOAR continues the discussion. Our panel of experts—a litigator, an adjudicator, an investigator/trainer, and a privacy expert—address our evolving reality. What have we learned? Has human connectivity suffered when we are screen-bound? What tools have been created or improved to assist the players at the table? Are there new efficiencies? How has the pandemic affected issues around personal privacy, data collection? Have parties forsaken their rights because of delays or other frustrations? Have professional roles adapted to confront shifting responsibilities?

Speaker Biographies

Esi Codjoe is a lawyer at Turnpenney Milne LLP, her practice focuses on workplace law including, employment law, human rights law, training, investigations and mediation. She is a previous Vice Chair at the Human Rights Tribunal. Esi taught Business Law and Labour and Employment Law at Ryerson University.

Esi was legal counsel, employee/labour relations at McMaster University; she provided advice on employment and labour matters. She was in-house litigation counsel at the Ontario Nurses’ Association. Esi routinely litigated grievance arbitration cases and provided advice on human rights matters.

Esi is an executive member of the OBA’s Labour and Employment Law Section. She was the Toronto Regional Director on the OBA Board of Directors and member of the Governance Committee. Esi is a past chair of the OBA Equality Committee. From 2009-2013 she was an executive member of the CBA Labour and Employment Law Section. She has served as the Secretary, and Director of Professional Development for the CABL. In 2018 Esi was named as one of Canadian Lawyer Magazine’s Top 25 lawyers in the area of Human Rights. In 2019 she was awarded a Lexpert Zenith award as a Change Agent in Law.

David Goodis is a partner at INQ Law, specializing in privacy and access. David is a graduate of Western University's law school, and was called to the bar in 1988. For over 30 years, David was a senior information and privacy lawyer with Ontario's Information and Privacy Commissioner. He held the roles of assistant commissioner, director of legal services and manager of adjudication with the IPC. He is an experienced litigator, and has appeared before the Divisional Court, the Ontario Court of Appeal, and the Supreme Court of Canada. David teaches administrative law and privacy law at the University of Toronto’s Faculty of Law and Osgoode Hall Law School, and is the Past Chair of the Ontario Bar Association’s Administrative Law Section. David also is an author of privacy law materials for the Law Society of Ontario's bar admission course.

Megan Keenberg - After a decade on Bay Street, in 2017 Megan Keenberg co-founded Van Kralingen & Keenberg LLP – a boutique commercial litigation and employment law firm. She is a Certified Specialist in Civil Litigation and practices commercial litigation. Megan holds a Master of Laws from Osgoode specializing in Dispute Resolution. She has also completed the Toronto Commercial Arbitration Society’s prestigious Gold Standard Course on commercial arbitration and has returned as faculty for the 2021-2022 term. A member of the inaugural NextGen Roster at Arbitration Place, Megan has been designated as a Qualified Mediator and a Qualified Arbitrator and maintains a mediation and arbitration practice focused broadly on business disputes arising from a wide variety of sectors. Megan also offers case management arbitration designed to promote procedural efficiency for cases proceeding before the courts.

Megan is an active member of The Advocates’ Society, having served as a Practice Group Leader for the Arbitration and Mediation Advocacy group, and currently serving on the 10+ Standing Committee. She is also an active member of the Ontario Bar Association having served concurrent terms on the Executive Boards of the ADR Section (including as Chair 2019-2020) and the Civil Litigation Section since 2017. Megan is a frequent speaker at seminars geared towards litigators, ADR practitioners and law firm management.

Tsering Sergong was appointed Assistant Deputy Chairperson (ADC) of the Immigration Appeal Division (IAD) at the Immigration Refugee Board of Canada (IRB) in March 2021. She joined the IRB as a Member in March 2019. As part of Canada’s largest independent administrative tribunal, Tsering plays a central role in realizing the IRB’s vision of being an active partner in the building of a responsive, innovative, and fair immigration system. In the context of the pandemic, this has meant the IRB adopting a remote-hearings-only operating model which has marked a significant shift in the operational context. This new way of working has allowed the IRB to continue to deliver timely, well-reasoned decisions on various types of appeals including criminal inadmissibility, overseas family sponsorships, and loss of Canadian permanent resident status.

Prior to joining the IRB in 2019, Tsering held several positions with the Canada Border Services Agency (CBSA) over nearly 14 years of service, having engaged the immigration process at various points from port-of-entry operations to inland enforcement.

When not in front of a screen, Tsering is a devoted daughter and reigning favourite parent to her two young children + 1 very cute COVID-puppy.

 

Moderator Biography

John Gayle Since 2014, John has been a member of SOAR’s Education Committee since 2014. For the 2021 to 2023 term, he was elected to sit on the SOAR Board of Directors. He graduated from Queen's Law and has worked for a large Bay St. law firm, as well as the Ontario Ombudsman. John works as a Mediator, Investigator and Acting Adjudicator for the Information and Privacy Commissioner of Ontario. He is the former Board President of the Erin Mills Youth Centre and sits on the Board of Directors for the Aphasia Institute and The Neighbourhood Organization.
