The Office of the Chief Electoral Officer, Administrative Cluster, seeks an innovative and motivated leader to manage the investigative review, enforcement activities and official complaint process under the Election Act (EA) and the Election Finances Act (EFA), for all political entities and related stakeholders, ensuring activities are in alignment with Elections Ontario’s (EO’s) Compliance Strategy.
You will:
-
lead the development, implementation and management of EO’s investigative and enforcement program that addresses the identification, analysis and response to non-compliance with the EA and EFA;
-
establish and implement audit, investigative and reporting protocols and liaise with staff and external investigators on compliance processes;
-
be able to appear as an expert witness in regulatory proceedings on behalf of the Chief Electoral Officer (CEO);
-
coordinate and manage investigations and help make recommendations to the CEO for reporting apparent contraventions to the Attorney General of Ontario;
-
coordinate and manage the receipt, assessment, and response to complaints made to EO under the EA, EFA, French Language Services Act, and other applicable legislation;
-
conduct and oversee investigations relating to alleged privacy breaches;
-
oversee complex and politically sensitive investigations, including complaint-driven and risk-based audits/investigations of apparent contraventions of election legislation;
-
advise political entities and internal and external stakeholders regarding corrective measures to ensure compliance with statutory requirements;
-
prepare briefing materials for committees and senior executives analysing options and recommending appropriate courses of action;
-
prepare expert reports/affidavits suitable to be disclosed or entered into evidence;
-
prepare internal analyses and reports on compliance policies, identifying and commenting on emerging compliance and enforcement issues and developing proposals for legislative change;
-
liaise with Canadian and international electoral agencies and regulators on investigation and enforcement matters and represent EO in working groups;
-
lead/participate on various committees and coordinate the development and evaluation of policies, initiatives, projects to address policy/project related issues and concerns;
-
manage special projects of varying size and complexity; and
-
manage the work of the enforcement team and prepare and manage the team’s budget.
Qualifications:
-
highly developed management, leadership and administrative skills to manage staff and the day-to-day activities of the enforcement team, provide operational and functional guidance, and prioritize work;
-
demonstrated knowledge of and experience applying generally accepted accounting principles and financial audit strategies and processes normally acquired through designation as a Certified Accountant or equivalent professional training and/or experience;
-
demonstrated knowledge and experience in interviewing witnesses and gathering evidence in forensic investigations/audits;
-
experience in devising investigation/audit plans and leading compliance teams composed of internal and/or external professionals obtained by working for an investigative, regulatory, or law enforcement agency;
-
experience interpreting and explaining regulatory requirements (laws, regulations, guidelines, policies) to staff, decision-makers, regulated persons and entities, the public, and the media;
-
experience reviewing and establishing compliance processes, protocols and procedures;
-
experience training and developing staff in investigative/audit best-practices, techniques, methods, and report writing;
-
knowledge of federal, municipal or provincial election legislation;
-
knowledge of privacy principles and legislation;
-
experience working with internal and external partners to identify areas for cooperation, resource sharing, and alignment of management and business rules;
-
demonstrated knowledge of project management and planning practices and methodologies and experience conducting/managing operational planning, performance measurement and concurrent projects;
-
experience writing expert reports/briefs/affidavits suitable to be used in the prosecution of offences;
-
familiarity with public sector procurement rules as well as budgeting skills to plan/manage special projects of varying size, as well as project and unit budgets;
-
highly developed consultation and negotiation skills and demonstrated experience managing highly confidential, contentious and politically sensitive issues/matters;
-
highly developed oral/written communications and interpersonal skills;
-
demonstrated analytical, problem solving, research and organizational skills; and
-
willingness/flexibility to travel, if required, throughout Ontario.
